Law No. 13,429/2017, known as the Outsourcing Law, brought significant changes to labor relations in Brazil, allowing the outsourcing of core activities of companies, something that was previously restricted by legislation and labor jurisprudence. This change sparked heated debates about its effects on both employees and employers.

Before the enactment of Law No. 13,429/2017, outsourcing was only permitted for secondary activities, that is, those that did not constitute the company's main objective. For example, a technology company could outsource cleaning or security services, but it could not outsource software development, which is its core activity. The new legislation changed this scenario by allowing companies to outsource any activity, including core activities.

Another significant change was the subsidiary liability of the contractor regarding labor and social security obligations. Although the contracting company is not directly responsible, it can be held liable if the third-party company fails to fulfill its labor obligations.

The new legislation offers greater flexibility and reduction of operational costs. The balance between the interests of companies and employees is essential for outsourcing to contribute positively to the country's economic and social development.
