Payroll dereliction: companies may abandon the scheme before 2028 due to gradual re-energisation

Empresas de setores contemplados pela desoneração da folha de pagamento podem optar por abandonar o regime antes do prazo final de vigência, previsto para 2028. A reoneração gradual, que se inicia em 2025 e se estende até 2027, está tornando o regime menos vantajoso para muitos setores, segundo avaliação de Pedro Ackel, Diretor Jurídico e Tributário da Associação Brasileira de Provedores de Serviços de Apoio Administrativo (Abrapsa).

“A lei aprovada neste ano propõe um processo de transição que, ano após ano, tornará o regime de desoneração menos atrativo para muitas empresas”, afirma Ackel. A principal vantagem do regime de desoneração da folha tem sido a substituição da contribuição previdenciária de 20% sobre a folha de salários por uma contribuição calculada sobre a receita bruta das empresas, chamada de Contribuição Previdenciária sobre a Receita Bruta (CPRB), com alíquotas que variam de 1% a 4,5%. Essa modalidade tem sido particularmente benéfica para empresas com grandes folhas de pagamento, como as de tecnologia, construção civil e outros 17 setores da economia.

No entanto, a partir de 2025, as empresas enfrentarão um sistema híbrido de tributação, no qual a alíquota sobre a receita bruta será reduzida progressivamente, enquanto a contribuição sobre a folha de salários será gradualmente reintroduzida. Em 2025, por exemplo, a alíquota da CPRB será reduzida para 80% do valor atual, e as empresas terão que pagar uma contribuição de 5% sobre a folha de pagamento. Em 2026, a contribuição sobre a folha sobe para 10%, e em 2027, chega a 15%, ao mesmo tempo em que a alíquota da CPRB continua a cair. Esse modelo de transição tem gerado preocupação em setores intensivos em mão de obra, que já consideram a possibilidade de sair do regime antes de 2028.

“O sistema híbrido de tributação proposto pode fazer com que empresas que já possuem folhas de pagamento elevadas em relação ao faturamento vejam seus custos aumentar a partir de 2025”, explica Pedro Ackel. Ele observa que a projeção de custos salariais e o faturamento terão um peso decisivo na escolha das empresas entre permanecer ou abandonar o regime de desoneração. “Para aquelas empresas cuja folha representa uma parcela significativa do faturamento, o novo regime pode se mostrar financeiramente inviável, incentivando a saída do programa antes de 2028 e o retorno ao regime convencional de contribuição sobre a folha.”

Alguns setores, como tecnologia e construção civil, são especialmente afetados por essa transição, já que, neles, os salários representam uma grande proporção do faturamento bruto. Muitas empresas nesses setores podem optar por abandonar a desoneração já em 2025, devido ao aumento da carga tributária que a nova regra traz.

Possível retorno da pejotização

Um desdobramento possível dessa reoneração é o retorno da prática da pejotização. A pejotização consiste na contratação de profissionais como pessoas jurídicas (PJs), o que permite às empresas evitar encargos trabalhistas, como FGTS, 13º salário e férias. Com o novo cenário de oneração progressiva, é possível que as empresas comecem a desenvolver projetos de pejotização para funções de alto salário, buscando minimizar os custos que serão causados pela reoneração.

A pejotização, que perdeu força nos últimos anos devido a decisões contrárias da jurisprudência, pode voltar a ganhar espaço se a desoneração da folha se tornar financeiramente inviável para empresas de grande porte. “Profissionais de cargos estratégicos e altos salários serão os mais afetados, já que a pejotização é uma alternativa para reduzir os custos trabalhistas sobre essas funções”, acrescenta Ackel. Ele ainda sinaliza que antes da tomada de qualquer decisão a esse respeito convém analisar os riscos trabalhistas e tributários.

O futuro da desoneração e a reforma da tributação da folha de pagamento

A reforma da tributação da folha de pagamento, prevista para 2025, poderá impactar diretamente o futuro do regime de desoneração. “Há discussões em andamento para uma reforma mais ampla da tributação da folha, que podem tornar a desoneração da folha desnecessária antes mesmo de 2027”, afirma. Ele destaca que a reforma em estudo tem o objetivo de criar um sistema tributário mais eficiente e menos oneroso para as empresas, o que pode acelerar o fim do regime de desoneração atual.

Ainda assim, Pedro ressalta que, embora seja cedo para afirmar com certeza o impacto dessa reforma, ela trará mudanças significativas no panorama tributário brasileiro, e as empresas precisam estar atentas às possíveis alterações no regime de contribuição. “O fim antecipado da desoneração pode ser uma realidade, caso a reforma traga alternativas mais vantajosas ou simplificadas para a tributação sobre a folha de pagamento”, conclui.

Com a reoneração gradual prevista entre 2025 e 2027, o regime de desoneração da folha de pagamento, que atualmente beneficia setores intensivos em mão de obra, pode se tornar menos atrativo. Minha Quitandinha lança para o mercado o QPay, sistema de vendas exclusivo para lojas autônomas

THE Minha Quitandinha, startup de tecnologia em varejo que atua no modelo de franquia de minimercado autônomo, lança para o mercado o QPay, um software feito sob medida para o setor de lojas autônomas. Operando em cerca de 300 lojas, o sistema, que já registrou mais de 1,6 milhão de compras e transacionou mais de R$ 30 milhões, possibilita, por meio de uma jornada fluida e um aplicativo intuitivo, que os consumidores efetuem compras em menos de 19 segundos. 

De acordo com Guilherme Mauri, CEO da Minha Quitandinha, ao todo, a marca investiu cerca de R$ 5 milhões para desenvolver o QPay do zero. “Recebemos um aporte de investidores-anjos de R$ 1 milhão e, somando o valor com o capital proveniente do caixa da Minha Quitandinha, arquitetamos o sistema do zero, desde a primeira linha de código. Foi um investimento extremamente alto também em termos de tempo, uma vez que, fizemos uma grande aposta rodando o software em lojas reais e ajustando-o conforme os feedbacks. A cada nova funcionalidade que queríamos implementar, buscamos as melhores práticas do mercado, com bastante calma, o que obviamente elevou os custos, mas garantiu uma qualidade excelente”, explica o executivo.

Operando no modelo 3 em 1, o software, que tem como objetivo melhorar a jornada de compra e venda tanto para o shopper quanto para o varejista, pode ser utilizado em totem (ou POS), aplicativo para celular e no modo sistema de gestão para o vendedor. Segundo Mauri o grande diferencial do QPay é ter sido projetado com base no segmento de minimercado autônomo e não adaptado de outro segmento. “A maioria dos programas que são usados hoje, são originalmente de outros setores, como, por exemplo, máquinas de vending, resultando em soluções não assertivas, por vezes caras, lentas e complicadas, sem o foco necessário para a operação de lojas autônomas”, comenta o CEO.

Hospedado no servidor da AWS –  Amazon Web Services, o QPay pode ser personalizado de acordo com a marca aderente e auxilia os varejistas com funções como inventário, precificação, cálculo de margem por categoria e até a criação de cupons de desconto. E tem muito mais por vir, por meio da Inteligência Artificial, o sistema operacional também mostrará quais produtos comprar para repor no estoque, ajudará no gerenciamento do capital de giro e poderá ajudar com o marketing. Além disso, o QPay pode ser testado pelos varejistas antes que os mesmos adquiram um plano. 

Em um cenário no qual estima-se que existem entre 15 e 20 mil minimercados autônomos no Brasil, em um universo de mais de um milhão de condomínios, sem contabilizar empresas e outros locais que podem instalar lojas desse modelo, Mauri afirma que as expectativas são as melhores possíveis. “Nós sempre acreditamos no poder da tecnologia como um diferencial competitivo, e por isso desenvolvemos nosso próprio software, feito sob medida para o segmento de lojas autônomas. Identificamos uma lacuna no mercado, que está insatisfeito com os programas disponíveis atualmente.
