In general, AI tools dominate the news and popular imagination, but debates related to privacy policy and data protection are still scarce.
Since it was enacted, Constitutional Amendment 115/2022 has determined that the protection of personal data is a fundamental right, guaranteed to all Brazilians by the Constitution. However, the privacy policy of the most popular AI at the moment, DeepSeek, concerns some experts, who consider the automatic data collection as "keystroke dynamics," monitoring and capturing user behavior, a point of attention.

In the race to ensure the safety of artificial intelligence users, Brazil is circulating Bill No. 2338/2023, which establishes the Legal Framework for AI. Approved by the Senate, the project aims to regulate technology in the country, as well as to establish risk classifications to be followed. In recent weeks, the issue of consent and safety has gained prominence with the suspension of sensitive data collection (through the eye's iris) by the company Tools for Humanity in Brazil, which offered financial rewards to those who underwent the procedure.
