The recent resignation of Tallis Gomes to the position of CEO of G4 Education, made official on Saturday night (21), brought to light a series of discussions on the use of the General Data Protection Law (LGPD) as a tool for the 4cancellation of companies. Gomes' decision to leave office is seen as an attempt to close one of the most controversial cases of statements with serious repercussions in recent times. However, the incident may have triggered an important reflection on the ability of organizations to deal with an avalanche of requests related to compliance with the LGPD.
The alert came after the repercussion of the controversial phrase “Deus me livre de mulher CEO”, attributed to Gomes. In response, tutorials began to circulate on LinkedIn teaching users to request the deletion of their data from the databases of G4 Education, using the rights guaranteed by the LGPD. This movement highlighted the preparation of companies to respond to a large volume of requests for data deletion.
Bruna Fabiane da Silva, partner of DeServ Academy and elected one of the 50 Best Women in Cyber Security in the Americas by WOMCY (LATAM Women in Cybersecurity), highlighted that, although it is not a data breach incident, the use of LGPD to cancel the’ companies can become a new trend.“This situation serves as a warning for many businesses, especially those that are more exposed on the internet or have large volumes of data. If they do not have an efficient governance program or adequate privacy teams, they may face serious problems”, he said.
The expert explained that data subjects can request confirmation of the existence of processing of their data, ask for updating or correction of information, among other demands. If a company is not well prepared, it may not be able to respond adequately to these requests.
“For a company to be able to handle a large volume of requests and meet the rights of data subjects as determined by the LGPD, it is necessary that the entire process of governance and compliance in privacy is well structured. Are the DPOs of companies prepared for this? Are the privacy teams ready? And data privacy governance is effective enough to respond to all these individuals assertively and timely?”, asked Bruna Fabiane da Silva.
