With the exponential growth of online shopping, marketplaces, and transactions via social networks, 2025 brought important changes to consumer law in Brazil. A new set of regulations, already in force, redefines responsibilities, expands protections, and demands even more transparency in digital relationships. According to Rafael Caferati, a lawyer at the Jobim Advogados law firm, being attentive to these updates is essential to avoid losses for both consumers and companies.
“Consumers have gained more effective tools to demand their rights, especially in purchases made through social networks and marketplaces. Now, platforms can also be held accountable for problems in the delivery of products or the provision of services,” explains Caferati.
Among the main novelties, the obligation of platforms to clearly inform who the real seller of the product or service is stands out, the standardized return policy for purchases made on marketplaces, and the extension of deadlines to exercise the right of withdrawal in certain situations. “These changes emerge to balance a relationship that was very favorable to large digital platforms until then,” observes the lawyer.
Furthermore, the regulations established specific rules for sponsored ads on social networks, requiring greater transparency regarding the origin of the offers and the identification of paid advertising. For Rafael Caferati, this measure is an important advancement: “The differentiation between editorial and advertising content is essential for consumers to make purchasing decisions consciously.”
Companies also need to adapt. Failing to inform the consumer or failing to comply with the new requirements can result in significant fines and damage to the brand’s reputation. Therefore, the expert from Jobim Advogados warns: “Businesses operating in the digital environment must urgently revise their customer service, sales, and communication policies to ensure compliance with the new regulations.”
The year 2025 marks a turning point in the protection of online consumers in Brazil, and also a new moment of responsibility for digital platforms.
