ANPD accuses TikTok of irregular treatment of minors’ data

The National Data Protection Authority (ANPD) has determined that TikTok make changes to better protect the data of children and teenagers. The decision results from a monitoring process that began in 2021, which now moves to a new stage with the measures announced this Monday.

 ANPD requests the end of the ‘feed without registration’, allowing the use of the platform only with age verification, and strengthening verification and account deletion mechanisms. TikTok has 10 business days to deactivate the feed without registration and 20 business days to implement the other measures. If it fails to comply with the determinations, TikTok may face fines and new actions by the ANPD.

“In the LGPD, the processing of personal data of children and teenagers must have the consent of a legal representative for those under 18 years old. In addition, Brazilian law does not override the Statute of the Child and Adolescent, as do other countries that have their own legislation regarding the rights of children and adolescents,” explains Aline Deparis, CEO of Privacy Tools.
