ANPD imposes restrictions on Meta for privacy and ethical issues

The National Data Protection Authority (ANPD) has ordered the suspension of personal data processing by Meta. The objective, to train the company’s generative AI, raises crucial questions about the limits of current legislation and the ethical use of these technologies. It also highlights concern about the processing of data from over 102 million data subjects in Brazil without proper compliance with the General Data Protection Law (LGPD).

The Meta case sheds light on the applicability of ANPD sanctions to any company using generative AI to process personal data. There is currently debate on whether these measures are specific to large corporations or signal a more stringent approach that could extend to other technology operators.

Since the implementation of the LGPD in September 2020, Brazilian companies have been striving to adapt to the new regulatory requirements. However, according to the IT Trends Snapshot 2023 study by Logicalis, a global IT solutions and services company, only 36% claimed to be fully compliant with the established standards.

In this scenario, legal consulting businesses for technology companies are seeking to understand how to ensure the responsible use of personal data without incurring similar penalties. SAFIE, founded in 2020 and offering legal infrastructure solutions, is one of them. Lucas Mantovani, Partner and Co-founder of SAFIE, can provide insights on adopting proactive measures to avoid regulatory risks, ensuring that AI practices are in line with emerging legal standards, and discussing the future of privacy in Brazil.

Questions that may be addressed:

  1. What are the limits of current legislation regarding the use of personal data for AI training?
  2. What happened to Meta could happen to any company or only to those using generative AI?
  3. How can companies prevent such sanctions from the ANPD?
  4. Is there a way to use personal data to train generative AI without violating the Law?
  5. What can we expect from the legislative scenario and authorities in the coming years regarding generative AI and personal data protection?
