Individual Microentrepreneurs (MEIs), Microenterprises (MEs), and Small Businesses (EPPs) have until January 31, 2025, to settle their debts with the Federal Revenue Service and ensure their continued participation in the Simples Nacional regime. This measure is crucial to prevent the exclusion of over 1.8 million companies notified in October due to debts totaling R$26.7 billion.
According to the Revenue Service, those who do not settle their outstanding debts will be excluded from Simples Nacional starting February 1, 2025, losing benefits such as reduced and simplified tax burdens.
To regularize their situation, companies can access the Simples Nacional portal, e-CAC, or the PGFN’s Regularize system. The Revenue Service offers special installment conditions, including discounts of up to 100% on interest, fines, and legal charges, as well as installments in up to 133 installments with reduced down payments. The first installment must be paid by the final deadline.
According to Filipe Bandeira, a lawyer and accountant at Fonteles & Associates, regularization also involves State and Municipal Tax Authorities, depending on the company’s activity. “It is essential for companies to consult an accountant to identify any debts or pending issues that could prevent their continuation in Simples Nacional. Additionally, companies not yet in the regime but wishing to join must also settle their debts by January 31,” explains the expert.
Companies that fail to settle their debts will face exclusion from Simples Nacional; loss of tax benefits; difficulties in issuing invoices and renewing contracts; and a competitive disadvantage, especially in sectors dependent on permits and public contracts.
Sebrae emphasizes that keeping taxes up to date also ensures access to social security benefits, such as retirement and maternity pay, participation in public tenders, and credit lines.
With a simple and digital process, the Revenue Service aims to encourage the financial sustainability of businesses and ensure entrepreneurs take advantage of this opportunity to maintain their market competitiveness.
